It’s that time of year – paperwork season! Once the ornaments are boxed up and the 2018 glasses are on sale, it’s time to hit the ground running to ensure your business stays compliant this year.

Below we outline the basics of the EEO-1 Survey to help you understand what it is, why it matters, and who must submit it.

We also walk you through the proposed changes to the survey that were and were not implemented for this year’s reporting requirements.

Are You Compliant? EEO-1 Reporting Requirements

What Is It?

The EEO-1 Survey is a compliance survey administered by the U.S. Equal Employment Opportunity Commission (EEOC). Through this survey, the EEOC collects data on workforce demographics including the race, ethnicity, gender, and job category of employees working for applicable companies.

Sounds exciting, doesn’t it? Maybe? Okay, maybe not.

Although it may seem tedious, the data collected through the EEO-1 does serve a purpose. The surveys are used by the EEOC to discover our nation’s employment trends within companies, industries, and regions so they can support civil rights enforcement within these areas.

Why This Data?

In 2017, you may have heard rumors that the EEO-1 data requirements would be changing, along with its deadline for submission. However, only a portion of these revisions actually went into effect for the 2017 survey requirements.

The EEOC did in fact propose adding pay-data questions to the 2017 EEO-1 report, which would have required employers to submit W-2 wage information and total hours worked for their employees. The White House Office of Management and Budget (OMB) suspended these revisions, so there are no changes to the existing EEO-1 reporting obligations for the 2017 survey data.

As for the deadline…

When’s It Due?

This year, the EEO-1 filing deadline for your 2017 data is March 31, 2018. In the past, the EEO-1 filing deadline was originally scheduled for September 2017, but the deadline was moved to March 2018 in anticipation of the new pay-data reporting requirements.

These pay-data reporting requirements were not implemented for the 2017 survey submission, but the EEOC kept the new March 31, 2018 deadline. The EEO-1 must be completed and submitted online by March 31, 2018.

Who Must File?

There are two main groups who are required to file the EEO-1 Survey: private employers and federal contractors.

Private employers are required to complete the survey as long as they have 100 or more employees. State and local governments, primary and secondary school systems, higher education institutions, Indian tribes, and tax-exempt private membership clubs are excluded from this group.

As for federal contractors, they must file the form if they have 50 or more employees and fulfill at least one of the following additional requirements: (1) they are prime contractors and have $50,000 or more in contracts, (2) they serve as a depository for government funds, or (3) they are a financial institution that issues U.S. Savings Bonds and Notes.

How Many Forms?

If you determine that you must file the EEO-1, your requirements will differ slightly depending on how many locations your business operates from.

Employers with one establishment, in one location complete a single, standard EEO-1 form. However, employers with multiple establishments, in multiple locations need to file a few different pieces of information, including:

  • A report for the business headquarters
  • A separate report for each establishment with 50 or more employees
  • A consolidated report with employee information for all establishments over 50 employees
  • A list of all establishments with demographic and location information for each
